    When AP is approved, you get 3 copies. I went twice on intl trips and each time they took a copy. I am left with 1 copy of the AP.

    Now I need to go on one last intl trip (I have applied for renewal). I just have one copy of AP with me.

    How does it work? Will the officer just stamp the AP and make a copy?

    You mean 3 copies are 3 originals right to be more clear. You can use only 1 original when you come back and get it stamped each time with a new date.

    I have used the same orginal AP for at least 4 times now.
    You can carry copies of the original just in case.

    I dont know whether IV could raise this issue or members of each state could talk with the DMV (highest official) or even the governor of the state so that this ridiculous rule which is causing a lot of pain to lot of our members is taken care off. They introduced this rule to keep away people who are out of status to renew the lisence. For that they only need to check the visas / other documents and need not require the person to retake the whole test. The DMV claims that this is required because as of the date of expiry of your (non renewable) lisence, you actually dont have a lisence to renew and therefore have to redo the whole thing.

    Good idea. It is something state chapters can take up as an issue and take it to the local authorities. Michigan chapter had successfully done some advocacy effort. Those members can provide guidance if you are interested in taking it up in your state. IV will also help as needed and put its weight behind you, once you take it up as your action item at chapter level.

    I am not sure what you mean by there is no issue with my EAD.

    Here is an excerpt from an USCIS FAQ

    Who is eligible for an EAD that is valid for two years?

    The two-year EAD is available to pending adjustment applicants (i.e., those who have filed a Form I-485, Application to Register Permanent Residence or Adjust Status) who have filed for an EAD under Section 274.a.12(c)(9) of Title 8, Code of Federal Regulations (8 C.F.R.) and who are currently unable to adjust status because an immigrant visa number is not currently available. USCIS will continue to grant EADs that are valid for one-year for adjustment applicants who have an available immigrant visa number and are filing for employment authorization under 8 C.F.R. Section 274a.12(c)(9). In order to be eligible for an EAD with a two year validity period, an applicant’s I-140, Immigrant Petition for Alien Worker, must be approved.

    So my I140 is approved, when my EAD was approved on July 30th my priority date which is March 25. 2005 was not current.

    When discussing premium processing, capitalism etc categories, we should not forget that USCIS is a monopolist. There is no alternative, hense all screw ups, "premiums" etc. Capitalism has nothing to do with USCIS. This organization is a typical crippled socialistic child.

    I agree with this one. It is more about no competition and no incentive to do things faster. Premium processing is just what it says it is. Pay up and we will have an incentive to do it faster. Else put up with our delays.

    I wish they wud do something like premium processing from the WHOLE Green card process. I am sure people wud be more than willing to pay for that.

    Hi all,
    I started working with a company in July 2006 and applied for I-140 in Nov 2006 with an existing labor of Nov 2004. My company is in losses all the time but I am getting more than proffered wage since I joined. Recently I received Intent to deny notice as there is no evidence that company can pay my in 2005. My attorney has replied for Intent to Deny notice and also applied for new I -140 using my own labor.
    New I-140 got approved. I send a request for Interfiling to take out old I-140 from my 485 and use the approved I-140. when I checked the status of my case yesterday - both my old I-40 and 485 got denied. I didn't receive Denial notice yet.
    Please suggest my any options I have for not losing I-485 and EAD.

    If i upgrade my H1 to premium, would they upgrade and process my wife's H4 in premium. I know that there is no premium for H4. If i would have opted for PP at the time of submission, both the apps would have been processed in premium, but now since we have separate receipt numbers for H1 and H4, would they be processed at the same time. Any past experiences?????

    Hi,
    If married in India & want to take divorce in USA what is the procedure & will it be a valid divorce?

    Extremely sorry to hear that in this forum.

    If there are valid reasons (believe me, 99.9% of time they are worthless issues) and you fall in that 0.1% (both of you are aware and willing to go separate), please go to India get it settled.

    If you fall in 99.9%, talk to your spouse, take few days off from work, go out alone and get it settled within your home.

    As others said, it is an expensive process and headace you don't want to go thru.

    For me, I still believe you both can figure out and get back on track before it derails.

    If you have kids, young kids, please please please, think 99999 times before you do this. It is worth going thru this pain for them.

    If you are 30 years old, just think that its going to be another 20 to 25 years of active family life.

    USCIS is creating problems in our everyday life, we take that pain and ready to wait another 20 years for GC, why not for a spouse who is living with us everyday?

    Bottom line : 99.9% time it is WORTHLESS arguments that leads us to get frustrated...

    If you file for MTR with in 30 days you should be fine till the case is adjucated.

    As long as MTR is filed u r not out of status.

    My h1 got approved in june 2008. I did travel to China in September & entered back on Sep 10 using H4. Is it possible that my entry changed my latest status to H4?

    Come on...you entered using h4, this is the last status INS has for you.

    People with mulitple visas have to choose a status when they enter back in USA.
    where have you been sleeping.

    its ok, no biggie....

    One solution i will do in this case is, if you have a h1 visa stampled...then go out of country and come back on h1 status. Make sure you claim the days you were on h4 to be not counted against h1 days.

    If you donot have a h1 visa already, then talk to lawyer get all paper work and go to canada/mexico get a visa and come back on right status.

    There is no point in moving the PD if they cannot process the PD's who are current. This is what is happenning now in USCIS. I would rather they move it by small amounts and process those who are current than give false hope to people!

    Although it might seem very appealing to put in multiple applications to increase the chance of obtaining a visa, one would actually be aggravating the situation than alleviating it. So the thought process should be how can one prevent the lottery situation from arising.. applying for a single visa on a requirement basis should suffice. That said it is unfortunate that the current situation and cap forces us to think of ways to resort to finding loop holes and take un-required actions. In an ideal world they should increase the cap. But whatever cap we have now, does not give us the right to jeopardize others chances of getting a visa. We should work this out together. Lets not clog the system.
    Imagine hearing from somebody that they have a visa they never used when you don't have one, don't be that somebody.
    I am currently on a dependent visa and have to go through the H-1 process. I have a masters and have every intention to stick to that quota and apply only one.

    The last time i talked to iio, she said they are processing I485s received in Apr, 2007 and they will start mine in 2 or 3 months.(mine was received on july 24th and pd is eb3 oct 2003). she said, they will process the applications even if the pd is not current but only approve if the pd is current.

    Sigma makes a good macro, as does Tamron and of course Nikon. I would buy the Nikon if I had the largest budget, but the others are not far off, if any different at all, in the quality of images that they can produce. One of the members here speaks highly of his equivalent Sigma macro (except in Canon mount).

    With that said, it's a very bad idea to order anything from the site you mentioned. Check ResellerRatings (http://www.resellerratings.com/) to see some feedback before ordering anything from an online dealer. I highly recommend B&H (http://www.bhphotovideo.com/) for new gear and accessories, and KEH for used items. I have ordered from both numerous times, and have always been satisfied.

    Edit: as an afterthought, I must add that anyone who tells you that your underexposure is caused by using a 35mm lens on a reduced-frame DSLR is full of "it." The only "disadvantage" of using a 35mm-based lens on most DSLRs is that the image is cropped, so the angle of view is equivalent to a lens on a 35mm camera that is 1.5X longer. There are "digital" lenses (Nikon DX or Canon EF-S) which can not cover a full 35mm frame, and are typically extremely wide (to compensate for the "crop factor" mentioned previously), but any "digitally integrated" or similar lens from Sigma or Tamron is nothing but marketing hype, IMHO.
