With the revision of the bulletin being revoked, things kind of worked out ok. However why has'nt anyone looked into what exactly happened on July 2nd and who was responsible for what? All the questions that Zoe Lofgren asked were very legitimate. Why were they not answered? We had Condi Rice say that all visa's were exhausted; this was on TV. Was she lying or mis-informed by someone in her department? Who misinformed her? What was the motivation for revising the bulletin? Who ordered the mass-processing of pending applicatons that we have now seen? Why were all dates made current in the first place? Which agency did it and who did they not talk to?
If it were not for the flower-campaign induced media exposure, and the tough stance taken by Zoe Lofgren, USCIS/DOS could have gotten away doing whatever they wanted. What if the next time something like this happens Zoe is not working on the immigration subcommittee in the House? No one else stood up against this mangling of the law. If you steal a car and two weeks later go put it back where you took it from, it does not change the fact that you stole the car and must be held responsible for it. Anyone contacted the Ombudsman to see if he is doing a special report on this July 2nd fiasco?

I found that EADs from NSC are being issued for filers until Aug13, as of now. I guess the processing time is like a week and half of the week, for every day. So you could be getting in 3 weeks.

I just post a msg saying we can file 485 if 140 is pending. But after reading some other posts, I realize that we can file it only if PD from the labor we are using is current. If we want to use PD from an old employers application, we need to have date ported on new i140 application before 485 can be applied.
Is that true? In that case, 140 from my new employer is not approved yet.....so i cud not be able to apply for 485 here :-(

d15...if it is in the budget I would go for the D80 over it's smaller brothers. I like the addition of the larger viewfinder (and the replaceable cover is a big plus imo) and the larger sensor. You may also find the 100 iso setting appealing. I can't say much about the other features Nikon offers and what would be appealing to you as I am a Canon user but I am guessing you've already done lots of homework as you near decision time.
From the little I know about Nikon, It looks like they have a good selection of lenses as you build up your gear. So far as quality of images I can't speak bad of Nikon from what I've seen. You sound like your commited to Nikon and I won't try to change that but I will say the D80 looks better for the extra $$$

I would love to, as it will help IV community also, but unfortunately it is not very easy in a company to request change of lawyer when the lawyer is good one. I see from many comments here that the Chugh Firm is a good one. And the employer also feels the same. So what grounds can I request them change their processes which they are following for nearly 200 employees. It will be hard. Cant even ask..

The worst lawyer ever possible: never replied to email, never responded to phone and never communicated: what she was doing. She filed my case in EB3 without consulting me or my knowledge even (I had two Masters and international research) and I came to know about it many years later when I thought I could be getting green card any day and guess what i came to know that not from the lawyer but from USCIS.

However My I-485 has been pending since June 2005. If it was a medical question RFE they should have found out when it was applied: "initial evidence" (or within six months) or does this happen only when the case is picked up for processing ?
Also this brings up a good point as to what possible reasons can there be for which a RFE can be raised at this point in time (RFE for "additional evidence") ?
1) EVL with current job desc, compensation and full-time employment
2) Last few/All years Tax Returns/W-2. Recent Paystubs.
3) Evidence of legal status throughout the stay in US

looking at experiences on websites, medicals can come up right at the end too. The other common RFE is for birth certificate (asking for either translation or affidavits etc). Hang on a few days (keep pinging your attorney every day or every other day) to see what its about. It can sometimes take a week or two for you to receive the RFE from teh time the online status changes...

By law, you need to notify change of address within 10 days of your move.

If you plan to print larger than 11x14 (roughly), or if you want more cropping flexibility, the D80 is a clear choice. Otherwise, between the D50 and D70, the D70 has a few more options (check DPreview for feature lists) that may or may not matter to you. It also takes CompactFlash, so if you have any aspirations of moving up to a D200 or D2x-like camera in the future, the D70 will get you started with the right type of memory. If being limited to SD media doesn't bother you, then get the D50 and spend the money you saved on better lenses.

I changed jobs recently and retained my attorney from previous employer even though I had the option of using the current employer's attorney for free. The reason being
1. I had good relationship with my previous attorney.
2. I never know when my dates (EB-I 06/03) will be current and in case of a layoff or future job change, we need to update USCIS with the new attorney information which I thought will raise a few eyebrows and was not comfortable with this option.
3. Even though you change attorney and send the updated details to USCIS, chances are that they don't update the system and any RFE or information may still get sent to the original attorney that filed your I-485.
Note, that I am not suggesting you one way or the other, these are the reasons for making my decision, hopefully this will help you make an informed decision.

My attornety is through my company though I paid her.
I'm still concerned with this 'what if my employer and through him my attorney do something that might harm my case if I move to another company'( as my old company will not have me and that will make their business a difference)
And it's attorney who will have to let me know if there is any RFE in future.
For the same fear I'm not even asking my attorney any AC21 related doubts that I have as she may go to my employer , tell him about it and that would be like giving him reason to believe I'm moving out even before I made any move.
If I changed the attorney then there is other set of reasons to be concerned about.
I would really appreciate it if any one could suggest something on this dilemma that I'm going through (having gone through this themselves or otherwise).

In my experience, the best Realtor is the the guy who would stick with you, when some unexpected things happen in the deal. Example: One of my friends purchased a home. After every thing was done, they noticed a major repair costing a couple of $1000. When my friend talked to the seller, the seller simply washed their hands off, saying the deal is over. If you buy a home worth 300,000 and if the Realtor gives back 0.5% (typical) or even a 1% that amounts to only $1500-$3000. Not really a very big amount considering the cost of the house.

Hi Everyone,
I'm trying to get my SSN Done. I'm on a dependent H4 Visa and have my H1 approval .
I visited the SSN office with My I797, State ID and Passport : SSN officer straightforwardly rejected as I dont have my EAD card.
The Officer asked me to visit USCIS office to apply for EAD.
Please help me with this situation..Does a H1 get an EAD and then a SSN?

You can either be on H4 or H1.If you are on H4 you will not get an SSN No. Dependents are not eligible for SSN. You can get a denial letter from SSN office which will help you to get a Drivers License.
In case you entered the country on h4 and have now changed to H1, you would have received the approval notice with a new I-94 card printed on it at the bottom of the notice. Show that approval notice to SSN office and explain that you have changed your status to H1-B while in US. That should get you an SSN. On the other hand if your approval notice does not have the I-94 printed at the bottom of the notice, that means you have an H1-B approval but need to go out of US to get your H1 visa stamped. Until you do that your status is H4. So please check your approval notice,
