Ok ..
Now I dont want to change my employer .
But my employer doent pay when I am on bench . So I may not having paystubs after March .
Will it cause any problem to H1 extention ?

deeply concerned about the current retrogression of eb2 priority date to 2000.
Background:

Currently CIS and Statedept count ebdependents / derivatives under ebquota (according to CFR22)
However Sec 203, INA seems to layout the eb quota volume and lists eligibilities.
Looking at INA I am unable to find the link between ebdependent/detivaties and ebquota.
The I485 application "Part 2: App Type" Option b (derivative status for spouses and children)
seems to be related to quota listed in INA Sec. 203. [8 U.S.C. 1153] a - 2. (family quota)
and seems to be not related to INA Sec. 203. [8 U.S.C. 1153] b - * (employment quota).
Question:

What quota do dependents of Employment based AOS(I-485) LEGALLY fall into - is it the EB quota or FB quota?
If incorrectly classified ? Is there any legal option this mis-classification be corrected?

I am surprised with this thread. There is no Deadline for employemnt based GC (this was mentioned by Sen. Robert (Bob) Men�ndez,NJ when requesting to move the FB deadline which is clearly mentioned in the bill as May 01, 2005) . Please read the summary and text carefully.
Summary:
First five years
Total number of merit-based green cards includes sum of:
a.) First five fiscal years have same number of green cards as made available to EB category in 2005. This number is 246,878.
b.) Any visa number not used by family based category.
How the total number will be divided between Current system and new merit-based system and Y visa holders --
- 10,000 (or more) reserved for exceptional aliens under �Y� visa category.
- 90,000 (exactly 90,000 � not more not less) for backlogged (pending or approved I-140 applications). Currently, this number is 140,000.
- Remaining possibly goes to new merits system. Until the merits system is ready for accepting petitions, the Y visa holders probably get a shot at this since the clause says �No more than 10,000� � leaving room to let it go up from 10,000 to whatever is left.
and the TEXT of the Bill
�(A) for the first five fiscal years shall be equal to the
33 number of immigrant visas made available to aliens
34 seeking immigrant visas under section 203(b) of this
35 Act for fiscal year 2005, plus any immigrant visas
36 not required for the class specified in (c), of which:
37 (i) at least 10,000 will be for exceptional aliens
38 in nonimmigrant status under section
39 101(a)(15)(Y); and
40 (ii) 90,000 will be for aliens who were the
41 beneficiaries of an application that was pending

The letter does not say anything. It just says that your I-485 is denied.
It does not give nay reason. It does not even say to appeal..

Guys, I was just laid off and have efiled i539 3 days after the termination date for a status change to F2. Now working on the application letter. Do you think I should mention the layoff in the letter?
If I do mention it:
Con: The layoff might quickly catch the eyes of the immigration officer and if he want to check my status, he could find out the 3 days OOS.
Pro: My previous job was well paid. By mentioning it, I give the reason that why I want to stay at home as F2 instead of keeping the well paid job.
I guess I will mention it in the letter to explain the whole situation and hope everything will be all right. Let me know if anybody disagrees asap, I will mail out the stuff with in next two days.

I bought the new Sigma 105 ex dg lens from b&h and it shipped today. I just couldn't bring myself to pay so much for the Nikon when every review of the sigma that I read said it was just as good. I should get the lens on Wednesday.

As far as expresscamera.com goes, I learned my lesson. I searched for �expresscamera complaints� AFTER I got off the phone. I can't believe I fell for the bait and switch. When I completed my online order, I got an email that I had to call to verify the order. When I did, the operator asked what camera I was using and then asked why I was buying a 35mm film lens for a digital camera.<o:p></o:p>

This caught me by surprise and also made me feel a bit stupid. I asked what the difference was and what he recommended. He then sent me to another page on his site that had the sigma lens for $850 on sale for $750. He then told me that there was a rebate for $150 and he could file it for me for a fee of $50. I told him that I'd file it myself and he offered to wave the $50 fee. He then said that shipping would take 2 weeks and when I balked, said that he would upgrade the shipping to 3 day. The standard shipping price was over $50 with insurance. My total price on the lens was just under $650. By that time, I would have paid anything.<o:p></o:p>

I searched their site and found the Sigma ex dg lens for sale elsewhere for $370. The search function on the site does not work correctly, so it was not easy. What a scam... They have their technique down to a science. I doubt that many people actually end up with what they originally ordered.
