    I assume you haven't filed your I 1485 yet.

    Why are you even bothered about H1B status when you are working from India ? ( You don't need an H1B status to work from India. You can be on US payroll as long as your company is ok with that.)

    When you are in India, you can apply for an H1B and get a visa stamping while coming back.


    Thanks, You are right I havent applied for my I485 yet. I am only concerened about when I return back to US, will there is any issues at POE due to my long absence on H1B?

    Hi Kitiara,
    Ive had a look at your animation, and Ive got the size down roughly another 2k.

    What I did was I opened up the animation in fireworks and exported/optimised each layer, then I reopened each image and put them back on the canvas which I then trimmed to match your layers.

    What you could try is to only use photoshop for the image work and apply the text from fireworks, I'm not sure if this would make much of a difference but it might reduce it a further couple of k.:bandit:

    I am a physician MD currently doing IM residency on H1B. i have a job to start from oct 2007. since PDS for india are now current, i would like to know if my employer can file PERM for a prospective employee now in june. my univerdity lawyer is not clear or rather not willing to file.

    he can file but if you are thinking the dates will current until your perm LC is approved may be wrong.

    Thanks. I did contact USCIS and they have accepted my request to expidite the cast. It is to be seen if it will actually happen.

    My other question is, if my renewal does not come through in-time, since the renewal application is in system, can I continue working after the expiry of my current EAD? Or do I have to quit the job and/or leave the country?

    it is regarding the salary and unpaid dues..

    Unless you specifically say what your status is, what the dues are for, the agency that could help you cannot be determined.

    State Labor Department, US DOL Wage and Hour division or a civil/small claims case are your options depending on your state laws.

    I..sort of have turned philosophical abt the whole process. Having said that, I also see bright flashes off and on...(just kiddin'). I talk optimism, walk optimism, eat optimism, sleep optimism :) ..ends here!.

    If all that it takes is - a copy of our presentation to be mailed/emailed to this 'super cop' of a minister or his office, I would still do it. That way, I have at least challenged him..

    Yes, that will help the chennai consulate lines. And it is great for hyderabadis since we don't have to go to chennai, sometimes multiples times for a single stamping.

    my lawyer missed the 2nd july deadline even when he had all the papers. Now i am asking him to meet 30th july deadline he is not responding . what are the papers needed to file I485. Can I file it without lawyers help? He does have my immunization papers

    Hi Chi_Shark,

    I didnt get your analysis on "so i could possibly face a 7 day gap in work authorization". I am also eagerly waiting for my EAD but I was curious what makes you think about a gap of 7 days. Is it 'coz you complete 60 days of filing on Aug 17th and urs expires on 10th. But why 60 days, I thought it has to be 90 days before a request can be made for interim EAD. Please correct me if I am wrong.

    I am working for company A under H1-B visa and my PERM was approved early this year and my I-140 (EB2) is pending. I summitted I-485 last week since the PD is current again. Almost the same time, I moved to another department in the same company because of company reconstruction. The job seems to be having different requirements(>50% difference). I have a couple of questions:
    1. Within how long I need to inform my company lawyer and then USCIS that my job changed within the same company?
    2. What are the concequences if I do not inform my company laywer about my job change? Will USCIS know this in the future and deny my I-140 and I-485?
    3. Will my pending I-140 get denied since my job requirement changed (if my company lawyer inform USICS)?
    4. What are the possible outcomes for my I-485 under this job change situation?
    5. Is that possible that I just stay there as nothing happened and wait for USCIS response to my I-140 and I-485?
    6. What can be done in order to avoid a new PERM and new I-140? I really don't want to start all over again since who knows what the PD will be after Oct. this year...

    and wait it out for 6 months and then change ur employer and find a job with the same skill set. as per USCIS ur job description has to be nearly 90% same.. so for u the best option would be to wait and watch..u've no other choice..

    I am planning to use AC21 soon, if my employer revokes I 140, is that going to effect my case?

    My details:-

    Worked employer for 4 years
    Labour substitution 2.5 years back
    I 140 approved 2 yrs back(06/2006)
    I1485 filed in July 2007

    Kothuri you are most helpful. I agree and think I will benefit from filing one, but am concerned about the cost involved doing so.
    I currently cannot rely on my former employers lawyer and will have to pay for this myself.

    Can you give me an indication on the total amount of hours spend by your lawyer/total cost for doing this on your behalf?

    there is no law/rule saying that you need to stay with employer after getting GC. However, GC is for future employment, so some people have been asked in past (just read on internet, so take with grain of salt) at citizenship as to why did they apply for GC for an employer they didn't want to work for. IF you get asked that question, you need to have a valid answer (layoff etc.). Also that question alone may not decide the fate of citizenship.

    Finished FP this morning. Got LUD on 485 45 mins after FP completion. Status language changed from

    "The I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS was transferred and is now pending standard processing at a USCIS office. You will be notified by mail when a decision is made, or if the office needs something from you...blah..blah..blah"

    to

    "On October 9, 2007, we transferred this I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS to our LINCOLN, NE location for processing because they now have jurisdiction over the case...blah..blah..blah"

    Then got second LUD this evening with a 11/28 date on it, even though it was still 11/27, even on East coast. No change in mesg.

    Any thoughts???

    File an H-1B extension while the PERM appeal is pending, asking for one year extension beyond the 6th year. It will be approved with proof of the pending appeal. Then, file a prepare a new PERM filing, withdraw the appeal, and file the new PERM case. With LUCK, you will be able to get the PERM approved and Premium Processed the I-140 before the termination of the 7th year H-1B.
